Terms & Conditions of Sale

These terms and conditions govern all sales made by Da Noi A Voi, an individual business (micro-entrepreneur / auto-entrepreneur under French law) specializing in the retail of original vintage posters and period lithographs, via the website [danoiavoi.com]. These terms apply to the exclusion of any other conditions.

Da Noi A Voi is registered as a French sole proprietorship (entreprise individuelle). Before purchasing a poster on this site, you must read and accept the terms and conditions set out below. We sell only original vintage posters, never reproductions, unless explicitly stated otherwise on the product page.

ARTICLE 1 — THE CUSTOMER

The Customer declares to be a natural person, at least 18 years of age, with the legal capacity to place an order on the Site, or to hold parental authorization allowing them to do so.

When registering personal information, the Customer must ensure the accuracy and completeness of the data provided. Da Noi A Voi cannot be held responsible for delivery failure resulting from incorrect recipient information. Da Noi A Voi reserves the right to cancel any order if the Customer's IP address is located in a country different from the billing and/or delivery address, where this raises a reasonable suspicion of fraud.

Placing an order under these terms constitutes full acceptance of these Terms & Conditions by the Customer.

ARTICLE 2 — ORDERS

Placing an order on the Site requires following the checkout process step by step. Before final validation, the Customer can review the order details and total price, and correct any errors. Any confirmed order constitutes a sales contract and acceptance of these terms.

A confirmation email summarizing the order (products, price, quantity) will be sent to the Customer. The Customer accepts the use of email as a valid means of order confirmation.

Da Noi A Voi reserves the right to cancel or refuse any order from a customer with whom there is an unresolved dispute relating to a previous order.

ARTICLE 3 — PRICING

Prices are indicated in euros (EUR). As Da Noi A Voi operates under the French micro-entrepreneur VAT exemption scheme, prices do not include VAT (Article 293 B of the French General Tax Code — VAT not applicable).

Shipping costs are calculated separately at checkout and are not included in the displayed product price.

Prices may be changed without prior notice; however, products are billed based on the price in effect at the time the order is registered, subject to availability.

Purchasing a poster does not include the purchase of any intellectual property or reproduction rights attached to it.

International orders: for orders shipped outside the European Union, the Customer is considered the importer of the goods. Customs duties, import taxes, or other local charges may apply upon arrival. These charges are outside the scope of Da Noi A Voi's responsibility and are entirely the Customer's obligation, both in terms of declaration and payment to the relevant local authorities. We recommend checking with your local customs authority before ordering.

ARTICLE 4 — ORDER VALIDATION

By clicking the order confirmation button, the Customer declares having read and accepted these Terms & Conditions prior to placing the order. Validating the order constitutes acceptance of these terms.

Unless proven otherwise, data recorded by our systems constitutes proof of all transactions between Da Noi A Voi and its customers. Payment provider records constitute proof of financial transactions.

ARTICLE 5 — AVAILABILITY

As each poster we sell is an original, one-of-a-kind piece, availability is limited to a single unit per listing. Once a piece is sold, it is marked "Sold Out" on the Site and removed from active sale.

In the rare event a piece becomes unavailable after an order is placed (due to a processing error), the Customer will be informed by email as soon as possible, and the order will be automatically cancelled and refunded in full.

ARTICLE 6 — CONDITION GRADING & MOUNTING

We use the following grading scale to describe the physical condition of our posters:

A+ — Mint condition (no visible flaws, or negligible ones only)
A — Excellent condition (very light signs of wear, minor creasing)
A- — Very good condition (light wear, minor foxing, some creasing, minor marginal tears)
B+ — Good condition (visible wear, foxing, creasing, marginal tears, slightly faded colors)
B — Fair condition (visible restoration, small losses in margins, foxing, creasing, tears, faded colors)
B- — Below fair condition (visible restoration, losses in margins or image area, foxing, creasing, tears, significantly faded colors)

Each poster's specific condition and any restoration or linen-backing is described individually on its product page. Mounting options include:

Paper (unbacked)
Linen-backed (mounted on fabric backing)
Japan-backed (mounted on Japanese tissue)
Board-mounted (mounted on rigid board)

ARTICLE 7 — SHIPPING

Orders are shipped within [X business days] of payment confirmation. Products are delivered to the address provided by the Customer during checkout — it is the Customer's responsibility to ensure this address is accurate and complete.

Shipping is carried out via insured, trackable carriers. A tracking number is provided by email once the order has shipped.

Posters may be shipped worldwide. Estimated delivery times vary by destination and are provided for guidance only; they are not guaranteed.

Shipping costs include packaging, transport, and insurance.

In the event of a shipping delay, the Customer will be notified by email. As long as the order has not yet shipped, the Customer may request cancellation.

ARTICLE 8 — PAYMENT

Payment is processed securely via the payment methods offered at checkout (credit/debit card, and any other method displayed on the Site at the time of purchase).

ARTICLE 9 — RETURNS & REFUNDS

If you are not satisfied with your purchase, you have 14 days from the date of receipt to return the item. Return shipping costs are the Customer's responsibility. Upon receipt and inspection of the returned item, Da Noi A Voi will issue a full refund or, at the Customer's request, a replacement where possible (though, given the one-of-a-kind nature of each piece, replacement is generally not applicable).

After this 14-day period, all sales are considered final.

How to initiate a return: please notify us by email at ciao@danoiavoi.com before sending the item back, and include a copy of your invoice. The item must be returned in the same condition as it was shipped, securely packaged.

Items returned damaged, altered, or in a condition different from the one in which they were shipped will not be accepted for refund. For this reason, every piece is photographed (dated and timestamped) immediately before packaging, documenting its condition at the time of shipment.

Given the fragile and often unique nature of our pieces, we strongly recommend using a trackable, insured shipping method for any return.

ARTICLE 10 — PRODUCT CONFORMITY

We commit to replacing or refunding any item that arrives visibly defective, damaged, or not matching the order. Please report any such issue in detail, by email, as soon as possible upon receipt, ideally with supporting photographs.

Regardless of the above, the Customer benefits from statutory legal guarantees under French law, including the guarantee against hidden defects (see Annex below). Nothing in this article limits the Customer's right of withdrawal described in Article 9.

ARTICLE 11 — REFUNDS

Refunds under Articles 9 and 10 will be issued within 30 days of Da Noi A Voi receiving the returned item. Refunds are made via the original payment method used for the order. No cash-on-delivery reimbursement will be accepted under any circumstance.

ARTICLE 13 — INTELLECTUAL PROPERTY

All text, images, and content on the Da Noi A Voi website are protected under copyright and intellectual property law. Reproduction of the website's content, in whole or in part, is strictly prohibited without prior written consent.

Purchasing a physical poster does not transfer any reproduction, copyright, or related intellectual property rights attached to the artwork or design depicted.

ARTICLE 14 — LIABILITY

Products offered comply with French law in effect. Da Noi A Voi's liability cannot be engaged in the event of non-compliance with the laws of the destination country (for example, restrictions on certain imagery or content). It is the Customer's responsibility to verify import restrictions with their local authorities prior to ordering.

Photographs and descriptions of products are provided for guidance and are as accurate as reasonably possible, but are not contractually binding in every visual detail (e.g., color rendering may vary slightly by screen). Customers are encouraged to contact us with any questions prior to purchase.

Da Noi A Voi cannot be held liable for indirect damages, loss of enjoyment, or consequential loss arising from these terms, nor for delays or failures caused by events beyond its reasonable control (force majeure), including postal or carrier service disruptions.

ARTICLE 15 — GOVERNING LAW & DISPUTES

This contract is governed by French law. The language of this contract is English; in case of any discrepancy with a French-language version, the French version shall prevail for legal interpretation purposes under French jurisdiction.

In the event of a dispute, the competent French courts will be those of Strasbourg.

ARTICLE 16 — PERSONAL DATA

Information collected about the Customer is necessary for order processing and our business relationship. In accordance with the French Data Protection Act (Loi Informatique et Libertés) and the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, and request deletion of their personal data at any time by contacting us at ciao@danoiavoi.com. ANNEX — Legal Guarantee Against Hidden Defects (Summary, French Law)

Under French law (Article 1641 of the Civil Code), the seller is bound by a warranty against hidden defects of the item sold that render it unfit for its intended use, or that so diminish this use that the buyer would not have acquired it, or would have paid a lower price, had they known of them.

Under Article 1648 of the Civil Code, any action arising from hidden defects must be brought by the buyer within two years from the discovery of the defect.
